Because of this I am very familiar with helping my customers who have financial problems. Many of them are struggling to buy groceries, keep the power turned on, and pay for gas to get to work.

They are struggling to pay for the necessities just to survive and feed their family. In most cases they have missed payments on credit cards.

<strong>The credit card companies think that you should pay them before you buy groceries.</strong> If you are in this situation, then do not give a dime of your money to any credit card company.

A credit card is an unsecured debt. They don’t have any collateral to get their money back with. They can’t come get your car or take your house.

Because of that they cram hundreds of people into cubicles and “sic em” on people in financial difficulty. They make hundreds of calls each day. They lie and threaten people to scare them into paying.

If you are having financial problems, then just take a break from these people. Get them off the phone as quickly as possible. Hang up if the conversation has gone longer than 30 seconds.

Don’t believe any threats to sue you. I estimate that 90% of the threats to sue are never carried out. Even if they do sue and get a judgment they can only garnish 25% of your wages.

I estimate that 95% of all unpaid credit cards will never result in a wage garnishment. Now, I’m not saying you shouldn’t pay them.

But, get your life back on track before you do. Get all of the necessities paid for first. Every other payment should be caught up on before you pay them a dime.

You should have an emergency fund of $1,000 or more before you pay them. Your kids, healthcare for the entire family, and all other necessary expenses should be taken care of.

If your car is having problems and needs to be replaced, then buy a new car. Once you have everything in order financially, then you can start working with the past due credit cards.

But, don’t just pay them off in full. Most of them will accept a 10-20% of the original balance. Pay them what you think is fair. When paying them off never send them a check or give them your debit card info.

Some of their contracts have clauses that allow them to charge you more than you had agreed on the phone. Get everything signed and in writing.

Then mail them an untraceable payment method like a money order. That way they can’t take every dime out of your bank account. Thinking about a short sale?

Either way they will be in control of most of the process. The bottom line is that if they do not know what they are doing, then the short sale will be delayed.

You may find yourself waiting 3-4 months for the short sale for the short sale to be approved. Then, after waiting and hoping that you can buy your dream home, you will find out that the short sale lender won’t approve your offer.

“We are so sorry. We worked so hard to convince them to accept it, but they still turned it down”, the agent may tell you. Wouldn’t that be heart breaking?

Unfortunately some agents just do not understand the short sale process. They are too busy with other things and never have a chance to give the short sale negotiations the property attention.

Or, the short sale negotiator they hire may be too busy to give your short sale file the attention it deserves. This is why it is important to find an agent that understands the process backwards and forward.

They will give the file the proper attention or find someone who can. They will know how to overcome any problems and roadblocks that arise.

But, what about the remaining people? There are several reasons they are unlikely to be sued. Remember, in most cases they can’t collect any money without getting a judgment first.

<strong>Reason #1: It costs $1,000 or more to file a lawsuit in most states</strong>. Between the attorney fees and court costs, it will cost a lender $1,000 to $5,000 to convert the debt into a judgment. The $5,000 number is for people who fight them in court.

<strong>Reason #2: You can’t squeeze blood from a stone. </strong>Most people short sell their house because of financial problems. The banks know this.

They have learned from past experience how hard it is to collect money from someone who is having financial difficulties.

They can’t afford to lose a month’s worth of salary. But, <strong>here is the good news.</strong> There is a maximum amount that anyone can garnish. According to <a href=”https://www.dol.gov/compliance/guide/garnish.htm”>Department of Labor’s Website</a>, anyone garnishing your wages can take a maximum of 25% of whatever you earn.

Sure, it’s not fun to have 25% of your earnings taken. But, 25% is much less than the 100% that most people think they will take.

So, even if you do get a deficiency on your short sale, it is not the end of the world. They cannot take all of your money and ruin your life.

Before your lender can garnish your wages they usually have to go to court and get a judgment against you. That takes time and costs money. A lawsuit can cost them a thousand dollars or more.

The high costs causes lenders to think twice before sueing most homeowners. <strong>Even better news is the fact that there are a lot of loopholes.</strong> For example, in Florida the head of household is exempt from garnishment.

Most garnishments have to be approved by a judge. If you can show the judge that you have kids to take care of, then they may deny the garnishment.

Or, you can show the judge that a garnishment would cause you serious financial hardship where you couldn’t afford gas to drive to work.

The bottom line is that so few homeowners who short sell their house will ever be pursued with a garnishment.

Shelby County TN – I recently heard another so-called short sale expert say that the Federal Mortgage Forgiveness Debt Relief Act made it so that everyone gets to short sale with no deficiency

The unfortunate news is that this is not true. In some state, state law forbids the lenders from attempting to collect from the homeowner after a foreclosure or short sale. But, those states are the exception, not the rule.

Here is what the Federal Mortgage Forgiveness Debt Relief Act does. It enables a homeowner to walk away from an upside down debt without owing taxes on the loss.

See, in the past a homeowner that was released from an upside down debt would owe income taxes on the forgiven debt. It is called “Forgiveness of Debt Income.”

This short sale expert said the following: “I read the Mortgage Debt Forgiveness Act and it states that anyone who short sells their house will be released from the debt.”

It is sad that someone who considers themselves a short sale expert would be so misinformed. So make sure you check out everything before you start the short sale process.

If not, then they will know a title company that can do the research for you. A VA Short Sale is called a “Compromise Sale.” According to those guidelines, they will give a complete release if a seller participates in the short sale program, and there was no “fraud, misrepresentation, or bad faith” on the part of the homeowner. Ask your realtor “Hey, what are houses in my area selling for?” I’ve seen people who bought a house for $500,000. Guess what’s it selling for today? $300,000.

If your house has had a 40% drop in value, then you shouldn’t be paying a mortgage payment based on a value of $500,000. You should be paying a mortgage payment based on a value of $300,000. Make sense?

Here’s how to find calculate you should be paying. Google “amortization calculator.” Type in what your home is currently worth. Enter the interest rate you were originally paying.

Look at the example numbers below.

* A $500,000 mortgage at 6% interest is a monthly payment of $2,997.75.

* A $300,000 mortgage at 4.5% interest is a monthly payment of $1,520.06. Remember, interest rates have dropped a bunch lately.

It looks to me like this person is overpaying by $1,477.69 a month. Ouch!

<strong>Run the numbers for your house.</strong> If your lender forecloses on your house, then it’s not necessarily going to sell for the market value. Most foreclosed houses often sell for 85% to 95% of the value today.

Remember, knowledge is power. When you have this information you have a much better negotiating position with your lender.

You can say “Hey guys, foreclose on my house. But, be prepared to lose a ton of money.” Thinking about a short sale?

Shelby County TN – I received a note the other day from Andrew. He was upset that I would tell people that are upside down on their house to ask for a principal reduction from their lender. Here was his email.

“I saw your blog post about how the banks won’t approve principal reductions for people who are struggling financially.
You recommended that anyone upside down should short sale their house because that is the only way to get the amount they owe reduced.
These people took out a loan and made a promise to do everything in their power to repay it. I think it is wrong that you would openly recommend them break that promise.
All that does is make it harder for someone responsible to get a loan. They banks have lost so much money because people walked away from their mortgages that they are making it impossible for responsible people to get a mortgage. Andrew.”
<strong>Here was my response to Andrew’s email.</strong>
“Andrew, thank you for your opinion. Fortunately we live in America and everyone is entitled to their opinion.
I can understand that you are frustrated. It sounds like this has affected you personally when you tried to borrow money. But, let me ask you this.
I meet a homeowner named John. John’s company went under during the economic crisis and John lost his job. He was out of work for six months and burned up all his savings and retirement accounts trying to stay afloat.
Today John is working 2 jobs, but making less money than he did at his previous 1 job. He cannot afford his mortgage payment. His lender will not reduce the payment to where he can afford it.
If he pays it, then he can’t pay for groceries. He makes too much money to qualify for food stamps. So, what should he do?
Should he get a third job, work until he burns out, and then lose everything? Or, should he move to a more affordable house and try to get his life back on track?
I think he should do whatever he can to get his life back on track, whether that be a loan modification or short sale. I know you may think he should work 80 or 100 hours a week until he has repaid every single debt in full.
Ultimately John and his family have to do what makes sense for them. Fortunately, America gives you the freedom to make your own decisions on what is best for you. Thinking about a short sale?

“Home sellers in these hard hit areas are forced to lower their prices to compete with all the <a href=”http://www.trulia.com/foreclosure/”>foreclosures</a> on the market. As a result , these unattainable markets are so affordable it makes better financial sense to buy than rent.”

<strong>Here is how to calculate whether it will be cheaper for you to buy versus rent. </strong>

First, add up what you are paying for rent now. Add together your rent payment and what you pay for renter’s insurance. That is the monthly cost of renting.

Now, let’s add up the cost of home ownership. First, you have the monthly mortgage payment. Add in Home Insurance, Property Taxes, and any Homeowner’s Association Fees.

Now, subtract out the tax savings. To calculate that, take what you will be paying monthly for interest and property taxes. Multiply that by your combined state and federal tax rate.

That is your projected tax savings. Now you have the cost of homeownership and renting side by side to compare. This is good news if you are a home owner. Why? It means that we are closer to a real estate recovery.

Here was his question.

“I have owned my house since 2006. My employer reduced my salary by 30% and now I have to move out of state where I have found a new job.

The house is a problem. Since 2006 my house price has dropped by about $40,000. That means I have a $40,000 deficiency, which I don’t want to pay.

I have option to rent the house, but I am still considering a short sale. Any advice? Sergio.”

<strong>Here was our answer to Sergio’s Question:</strong> Sergio, I would attempt a short sale. Depending on your situation and the type of loan you have, more than likely you will not have a deficiency.

I can give you a better answer after I get more information from you.  I wouldn’t recommend renting the house. How hard is it going to be to manage when you are out of state?

What if the tenants stop paying? What if a pipe breaks and floods the house? I’m not saying don’t rent the house. I just know from past experience that managing rental property from a distance is super tough.

I knew a real estate investor who targeted what he called “tired, out of town landlords.” He would offer to buy their property below market.

Surprisingly, many of them accepted his lowball offers because they were so tired of dealing with the property. Here is the other downside on renting.

You will probably have negative cash flow every month. I don’t know what your house will rent for.  But, if you are upside down on your house value, then you are likely also upside down on the rental value.

That means you will almost certainly lose money on the rent every month. With your precarious financial situation, recent 30% salary cut, and move out of state, the last thing you need is another bill each month.

With a short sale you can walk away owing nothing, with no tax liability, and be eligible to buy another house in 3 years.

That sounds a lot better to me than being stuck with a money losing house 2 years from now. Thinking about a short sale?
